Former employees of GHA Coaches have succeeded in a group compensation claim, winning damages that will ‘help them move on’.

320 jobs were lost in July 2016 when the Ruabon based company collapsed into administration.

Administrators were appointed after the business, which operated public and school bus services across Wrexham, Flintshire and Denbighshire – along with parts of Cheshire and Shropshire, received a winding-up petition from HMRC over unpaid taxes.

In August 2016 it was announced that a number of former GHA employees had contacted lawyers about making a possible group compensation claim.

Employment lawyers at full service law firm JMW Solicitors LLP worked on behalf of 183 former GHA Coaches employees in respect of their claims for protective awards ‘following a failure by the company to properly consult’.

A Tribunal ruled that GHA failed to properly consult with employees before making dismissals so they are entitled to 90 days’ pay.

GHA Coaches has also been ordered to pay the Tribunal fees.

Commenting on the claim Liz Cotton, Partner and Head of Employment at JMW said: “We are delighted to have won the judgment for GHA’s failure to consult properly over the redundancy of their employees.

“We are pleased that the Judge felt GHA should have done more to consult with their employees when they knew the company was in trouble. The damages will hopefully help the ex-employees be able to move on after losing their jobs with no warning at all.”

GHA went bust owing over £5m, with a 20 page list of unsecured creditors including many local businesses – full story on that here.
