My guess, and I would stress it is a total guess, is either a legal challenge is being considered / put forward as an option or it is a discussion on the impact on finances etc both possible under Part 2 ?

This is based off previous comments on the below link, however the answer given during that speech indicated any challenge would have come before the listing decision itself.
