Oh, I comprehend ……… You are basically saying do what you want as the fines cant be enforced ……. its like all those ididots that say parking eye cant take you to court ……. tell that to Barry Beavis … £85 ticket goes up to £850.
If you read what have posted so far on fines that is to do solely BEFORE conviction – a reminder:
    Bill of Rights [1688]
    1688 CHAPTER 2 1 Will and Mar Sess 2

    Grants of Forfeitures.

That all Grants and Promises of Fines and Forfeitures of particular persons before Conviction are illegall and void.

    Source: http://www.legislation.gov.uk/aep/WillandMarSess2/1/2/introduction

On that which you raise Beavis v Parkingeye:

On reading what was deliberated by the bench. What appears to have been judged in this case is nothing to do directly with liquidated damages (loss of income) or even to do with a penalty deterrent in connection with overstaying which could not be enforceable as it is “over the top”, unconscionable for a going rate for market priced car parking. It is solely to do with business reputation, as if parking eye could not be seen to do what they professed it would ruin a business reputation & cause further business damage down the line.

It would appear way off what the whole of this was about in the 1st place & more attention should have been paid to that. This outcome is nothing more than a complete sham (simply “doing someone over” because they can) of any distinction. Even trying to play out all possible variations of a scenario then what these idiots come out with is pure bull shit.

It is quite possible he was found “guilty” because he appealed (making a plea as in – am guilty but take into consideration…)! This apparently is seen as CONTRACTING/JOINDER, so if you don’t want to contract lose the name!

NEVER APPEAL – start by looking & considering some of the pointers below – make up your own minds though & modify to suit your own needs.

This I found on getoutofdebtfree.org in a post on parking eye.

“Someone has already posted in the parking forum on this site about “Mr. Loophole” advising people that dont want a ticket on council land to put a notice in the car window “car ILLEGALLY parked NO contract/joinder NOT subject to T(s) &C(s)” that is on Freeman&Co web site (cant find the link though) this is rebutting ANY claims made by council that would stand as truth in court! So carry on as before.”
For anybody that believes they can shout Boo! then run away.
Looks not to be the case Joan The Hog. :)
Question has to be asked is there a contribution to the administrative cost of issuing the fines from the enforcement company or is the cost borne fully by WMBC ?
There has yet to be any comment regarding the commercial basis of operation ie is the method that Wrexham Council pays between £42 to £55 (-ish) for each successfully issued ticket then looks to seek payment from succesfully paid fines ? If so, with a supposedly reported success ratio of around 60% of collecting fines, and with an council officer’s time being taken into account – will the system prove to be cost neutral – let alone result in any profit for the council ?

How keen on returning to Wrexham for shopping will anybody fined feel – not very – so every month the number of alienated potential Wrexham shoppers grows by around 500 – allowing for those stupid enough to be caught more than once.

Is it all worth it ?
mmm interesting post but I will try to answer some of your points, overall what you have posted backs up what have said about fines all along, its all about scamming us out of money & nothing else.

well, if you look at the 1st posting in THIS thread on page 4 by a member called “NEN” – “The little Hitler ran up to me and tried to issue a Fine. I tried politely to explain that it was an accident however he didn’t seem to understand this (I guess they are not the sharpest tools in the box) so I used a different approach and assertively shouted “NO!” in his face and walked off briskly. He seemed to understand this better as after a few metres he gave up and moved onto someone else. This is the only language these people understand” – says it all NO NAMES, NO DETAILS = £0 fine beat that – if you can?
Everyone complains about the state of the twon centre.
Yet Joan thinks its acceptable to thrown litter, fag ends etc on the ground for someone else to clean up. How about get some self respect.
You evidently don’t comprehend what have said all along. By all means point out where exactly have said its OK to litter, drop fag ends, etc.

My whole point is NO-ONE has to PAY FINES! What don’t you understand? The evidence has pointed out, it’s up to you if you want to be shafted by the council for fines, remember its all a money making SCAM – can’t spell it out any simpler!
The point is that they may have issued £42,000 of fines but they should be saying how much they collected!

You will never see the headline “Wrexham smokers pay £42 worth of fines in a month”

it would be interesting to see how much was collected as a percentage of fines issued to gauge the efficiency of the system.
Hopefully they will have collected NONE!

What’s the matter NO-ONE read my thread on Dog Fouling

Read it. Laughed at it. Forgot it..

    Perhaps should have said

They prove applicability of statute/acts to you the Human Being.

What’s the matter NO-ONE read my thread on Dog Fouling & FINES – DON’T PAY how many more times. You have only yourselves to blame. Remember its all about money making for the council. Ask yourself will it stop anyone from dropping fag ends?

    REMEMBER – NO PERSONAL DETAILS.

    DEMAND
    1. They prove authority over you.

    2. They prove your obedience to statute/acts (thats all they are an ACT just like going on stage!)

    3. They prove your applicability to statute/acts.

I know this has been about ASDA but for me the more over all sentiment is they should be gone from everywhere.

The only thing I can say is TOTALLY get rid. There is nohting else to say. As a cyclist have been over the damn things & nearly had several accidents due to been thrown off balance. Is there any point in complaining? No because the council won’t take any notice (even if they pretend) & won’t do anything about it. I think Stryt Las in Rhos, all over high town, Brynteg & many other places, they need to be gone!

They are dangerous to cyclists, motorists, & pedestrians alike, some say they are needed outside schools, well when I was in school never had them then & no one got knocked over, there have been several oppositions to these humps from when I think possibly in 1994 some of the 1st were put in outside the school in Boras, other areas included Coed-Y-Glyn outside the Catholic School & along to the Squire York pub.

The only real thing to do is get rid, because no-one gets together & challenges the council they all ride rough shod over everyone! Or better still simply take them up if you have a digger!
